Internet ACCESS SERVICE AGREEMENT

This Rocket Broadband Internet Access Service Agreement, including the attached Terms and Conditions and other attachments hereto (the "Agreement"), sets forth the terms and conditions under which Rocket Broadband Communications Corporation ("Rocket Broadband") will provide Broadband Internet Access Service to you. This Agreement is entered by you ("Customer" or "You") for You and members of your household and by Rocket Broadband for itself and its subsidiaries and affiliates that provide the Broadband Internet Access Service (the "Rocket Broadband Service"). Rocket Broadband Service may include brands such as but not limited to: Rocket Broadband High Speed Internet Standard, Rocket Broadband High Speed Internet Premier; Rocket Broadband High Speed Internet Basic and any variation thereof.

The attached Agreement Terms and Conditions, and other attachments hereto, which are incorporated herein, explain important details concerning the Rocket Broadband Service provided by Rocket Broadband and your obligations in order to obtain and keep Rocket Broadband Service. The following topics, among others, are explained in the attached Agreement Terms and Conditions and other attachments:

• Rocket Broadband may amend this Agreement, including the attached Terms and Conditions and other attachments hereto, at any time by posting revisions on the Rocket Broadband Internet Site.
• Rocket Broadband does not guarantee the availability of any particular bandwidth or feasibility of use of Rocket Broadband Service for a particular purpose.
• Rocket Broadband may offer multiple Rocket Broadband High Speed Internet products or packages now or in the future that consist of varying features and restrictions, including but not limited to, different speeds, traffic consumption allowances, or email accounts, among other product attributes. You agree that your usage will remain within the parameters established by Rocket Broadband for your particular package, and that You will pay any surcharges that are established and communicated to You as being applicable for exceeding the limits of your particular package. Product and package features and restrictions are subject to change at any time, with or without notice, in Rocket Broadband's sole discretion.
• You may not use Rocket Broadband Service to operate a customer-based server of any type.
• You are responsible for the security of your own computer system and for preventing use of your Rocket Broadband Service by others.
• Rocket Broadband is not responsible for any bugs, viruses, Trojan Horses, worms, spyware or other damaging software You encounter when You access the Internet using Rocket Broadband Service.
• You may have to pay a re-connect fee if your Rocket Broadband Service is disconnected for non-payment or violation of this Agreement.
• Any cable modem or other equipment supplied by Rocket Broadband under this Agreement is the property of Rocket Broadband.
• You agree to indemnify and hold harmless Rocket Broadband against any cost, claim, liability or expense arising from or related to your use of Rocket Broadband Service.
• You have certain protections under U.S. law as outlined in Rocket Broadband's Privacy Policy.
• New York State law governs the attached Agreement.
• You agree to binding arbitration to settle any dispute that You have with respect to the Rocket Broadband Service or this Agreement.

By signing below, I authorize the installation and acknowledge that I have read, fully understand, and agree to this Agreement, including the attached and incorporated Terms and Conditions and other attachments hereto. (For all professional installations, Rocket Broadband technicians or contractors will provide customers a written copy of this Agreement, attachments and these signature pages at the time of installation or ensure that on-line registration and acceptance has been completed.)
